Intelligence- and security services

“Jemand mußte Josef K. verleumdet haben,
denn ohne dass er etwas Böses getan hätte,
wurde er eines Morgens verhaftet.”

Franz Kafka, first sentence of  ‘The trial’

Prakken d'Oliveira specializes in cases involving the Dutch general and military intelligence services (the 'AIVD' and the 'MIVD'). Prakken d'Oliveira is the only law firm in the Netherlands that focuses explicitly on these kinds of cases, combining our knowledge and experience from different areas of law.

Intelligence services have the legal right to investigate organizations and individuals if there are serious indications or suspicions that they may pose a threat to the Dutch state. Additionally, these services perform background (security) checks of candidates applying for confidential functions.

Both the AIVD and the MIVD conduct their work in the greatest secrecy. The invasion of citizens' privacy is the rule rather than the exception. The methods employed by these services can have far-reaching and often undesirable consequences for those involved. Prakken d'Oliveira keeps a close eye on the limits within which these services are allowed to operate.

In intelligence- and security cases, we represent individuals and organizations who are under particular scrutiny by these services and have experienced problems as a result: political activists, suspects of terrorism, independence movements, journalists as well as civil servants.
